Spotineo terms of use

What these terms cover. The Spotineo app for iPhone and iPad, from version 5.0, its widget, polls created from the app and the Spotineo+ subscription.
What they do not cover. Browsing madebyaks.com and spotineo.madebyaks.com, and voting from the web page, fall under the AKS websites terms of use.
1. Who provides Spotineo
Spotineo is published under the AKS brand (Made by AKS). The publisher’s identity and contact details are in the legal notice. In these terms, “we” means the publisher.
Spotineo is distributed on the App Store. Apple distributes the app, collects subscription payments and manages subscriptions, but is not the publisher of Spotineo and is not a party to these terms.
2. What you agree to by using Spotineo
By installing or using Spotineo, you accept these terms. They apply in addition to:
- Apple’s standard licence agreement for apps, which sets out your right to use the app on your Apple devices;
- the Apple Media Services terms and conditions, which govern your purchases on the App Store.
These terms supplement those two texts on what is specific to Spotineo: how it works, its plans, its polls. They do not override them, and none of them deprives you of the rights the law gives you as a consumer.
3. The service
Spotineo lets you save places you would like to try, organise them, draw one at random from your places or from places nearby, keep track of your outings and ask the people close to you to vote between three places.
The app works without an account. Your places and your history are stored on your device.
The draw is a decision aid. Names, addresses, locations, views and travel times come from Apple Maps or from what you entered yourself: before you set off, check that a venue still exists, that it is open and that it suits you.
4. Free version and Spotineo+
The free version can be used with no time limit. It includes saving places, draws, comparing several ideas and polls, within limits the app shows you: number of places, number of polls a day, access to certain features.
Spotineo+ lifts these limits and adds further features. The offer screen in the app shows at any time what Spotineo+ includes; that description, as displayed when you subscribe, is the reference.
If you used Spotineo before version 5. Your places remain unlimited and you keep the minimum-rating filter, with or without a subscription.
5. Discovery period
On first install, all Spotineo+ features are open for a discovery period, with no purchase and no payment method. The app shows how long it lasts and how much time is left. This period never turns into a subscription: when it ends, you carry on with the free version, unless you choose to subscribe.
Nothing is erased when the period ends. Spotineo+ features lock; if you have saved more places than the free version allows, you keep them all, but you can no longer add any. Reinstalling the app does not start a new period.
6. Spotineo+ subscription
Plans. Spotineo+ is offered as a monthly or a yearly subscription. Both plans give access to the same features; only the duration differs.
Price. The price of each plan, including all taxes and in your currency, is shown in the app and on the App Store before any purchase. That is the price that applies.
Payment. The purchase is charged to your Apple Account when you confirm it. We receive neither your contact details nor your payment method.
Automatic renewal. The subscription renews automatically at the end of each period, for the same duration and at the price then in force, until you cancel it. The renewal amount is charged within the 24 hours before the end of the current period.
Cancelling. You can cancel at any time, free of charge and without giving a reason:
- on your device: Settings › your name › Subscriptions › Spotineo;
- from the app: Me tab › “Manage my subscription”.
To avoid the next renewal, cancel at least 24 hours before the end of the current period. You keep Spotineo+ until the end of the period already paid for. Deleting the app does not cancel the subscription.
At the end of the period already paid for. You return to the free version. Nothing is erased: your places, lists, moods and history stay on your device. If you have more than the free version allows, you keep them all but cannot add any.
Changing plan. You switch from one plan to the other in your Apple Account settings. The change takes effect according to Apple’s rules.
Restoring. If you change device or reinstall the app, “Restore my purchases” finds your subscription with the same Apple Account.
Price changes. If the price of your subscription were to change, Apple would tell you in advance and you could cancel before the new price applies. Where the law or Apple’s rules require it, the new price applies only with your agreement.
Family Sharing. The subscription cannot be shared with family members.
7. Withdrawal, refund, defect: three separate routes
Your purchase is made through Apple, which collects the payment. The route depends on your situation.
You change your mind: the right of withdrawal. If you are a consumer in the European Union, you have 14 days from receiving your receipt to withdraw, without giving a reason. This right is exercised with Apple: from the purchase history of your Apple Account, or by any clear statement sent to Apple, in the manner and with the exceptions set out in its terms.
You are asking for a refund for another reason. Go to reportaproblem.apple.com, sign in with your Apple Account, choose “Request a refund” and select the purchase. Apple reviews the request and decides what to do with it.
Spotineo+ does not work as expected. Write to us at support@madebyaks.com. It is up to us to put the service right; your rights in that case are described in section 8.
We cannot issue a refund ourselves on a payment made through Apple. This does not reduce any of your rights: if a refund is due to you, we do what is needed for you to get it.
8. Legal guarantees
If you are a consumer, you benefit from the legal guarantee of conformity that applies to digital content and digital services (articles L. 224-25-12 and following of the French Consumer Code). For a subscription, it covers any lack of conformity that appears throughout the subscription. If there is one, you can ask for Spotineo+ to be brought into conformity, free of charge and without undue delay; failing that, for a price reduction or for the contract to be ended with a refund.
Throughout your subscription, we provide the updates needed for the app to work properly, and we tell you about them. If, within a reasonable time, you do not install an update whose availability and consequences of not installing we have pointed out to you, we are not liable for a defect that results solely from its absence, provided our installation instructions were correct.
9. Your content and its backup
The places, ratings, notes and photos you add belong to you. They are stored on your device and we have no access to them: we therefore cannot restore them for you.
To protect them, use your device backup and the export offered in the Me tab. The export contains your places, lists and visits, without the photos. Deleting the app without a backup means losing this data.
10. Polls with friends
When you create a poll, the name and neighbourhood of the three places, and your first name if you give it, are put online for 48 hours and are visible to anyone who has the link.
- Share the link only with the people you want to vote.
- Do not include any content that is abusive, unlawful or infringes other people’s rights.
- Do not try to distort a poll or overload the service.
A poll accepts a limited number of votes and cannot be extended. We may delete a poll that is clearly abusive or unlawful. If the voting service is unavailable, the app offers to share the three places as text instead.
11. Third-party services
Some features rely on services we do not control: Apple Maps for places, maps and routes; the App Store for subscriptions; the navigation apps you choose to open (Apple Maps, Google Maps, Waze, Citymapper). Their use is subject to their publishers’ terms, and their availability may vary by country, network or time.
12. Using the app
Spotineo is intended for personal use. You agree not to use it in a way that breaks the law, not to get around the limits of the free version or of the subscription, and not to disrupt the voting service.
If you are a minor, you use Spotineo with the agreement of your legal guardian, who must also approve any subscription.
13. Changes and availability
Spotineo changes over time: we fix, improve and adjust its features from one version to the next, at no cost to you. A feature that depends on an online service may be temporarily unavailable.
If a change were to noticeably reduce access to Spotineo+ or what it gives you, we would tell you in advance, clearly, stating what changes and when. You could then end your subscription free of charge within 30 days and be refunded for the part of the paid period still to run. This right is in addition to the option, always open, of not renewing.
14. Intellectual property
The Spotineo name, the app, its interface, its texts and its graphics are protected. You have a personal right to use the app, within the limits of Apple’s licence agreement. Maps and place data remain the property of Apple and its suppliers.
15. Liability
We are responsible for the proper performance of the service we provide to you, including the parts we entrust to providers.
We are not liable where the problem is caused by you, by the unforeseeable and unavoidable act of a third party unconnected with the service, or by an event of force majeure.
Spotineo helps you choose a place; it does not run it. We are therefore not liable for the welcome, quality or safety of the places you go to, or for changes a venue has not yet made known (closure, opening hours, relocation).
Your data is stored on your device: backing it up is your responsibility, except where a loss results from a defect in the app.
Nothing in these terms excludes or limits our liability where the law forbids it, or the legal guarantees you benefit from.
16. Duration and end
These terms apply for as long as you use Spotineo. You can stop at any time by deleting the app, after cancelling your subscription if you have one.
If the voting service is misused, we may delete the polls concerned.
17. Changes to these terms
We may update these terms when the app or the law changes. The date at the top shows the latest revision. A change that affects your current subscription applies only from its next renewal, and you can cancel before then.
18. Governing law and disputes
These terms are governed by French law. If you are a consumer living in another European Union country, you keep the protection of the mandatory provisions of the law of your country, and you may bring a case before the courts of your place of residence.
